These Terms of Use (“Terms”) govern your use of the Cryptic Themes app and this website (together, the “Service”), provided by Grailbox, LLC (“we,” “us,” or “our”). By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Eligibility

You must be at least 13 years old to use the Service. If you are under the age of majority where you live, you may use the Service only with the permission of a parent or legal guardian, who agrees to these Terms on your behalf.

Your Account

You are responsible for keeping your account secure and for all activity under your account. Please give us accurate information and let us know at support@grailbox.com if you believe your account has been compromised. You may delete your account at any time.

Subscriptions and Payments

• Free and Pro tiers. Some features are free. Others, such as daily puzzles and statistics, require a paid Pro subscription.
• Billing. Subscriptions are purchased and billed through the Apple App Store or Google Play, and are subject to their terms. We do not process or store your payment details.
• Automatic renewal. Subscriptions renew automatically at the end of each billing period unless you cancel at least 24 hours before the period ends.
• Cancellation. You can cancel at any time in your App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period.
• Refunds. Refunds are handled by Apple or Google under their refund policies.
• Price changes. We may change subscription prices. Any change will be communicated in advance as required by Apple, Google, and applicable law.

License to Use the Service

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the Service for your own non-commercial entertainment, subject to these Terms.

Acceptable Use

You agree not to:

• Copy, redistribute, sell, or publish our puzzles, clues, or other content, except for sharing your own results through the sharing features we provide
• Reverse engineer, decompile, or attempt to extract the source code of the Service, except where the law allows it
• Use bots, scrapers, or other automated means to access the Service or collect puzzle content
• Interfere with, disrupt, or attempt to gain unauthorized access to the Service or its servers
• Use the Service for any unlawful purpose

Intellectual Property

The Service, including its puzzles, clues, themes, design, logos, and software, is owned by Grailbox, LLC and protected by copyright, trademark, and other laws. These Terms do not give you any ownership rights in the Service.

Privacy

Our Privacy Policy explains how we collect and use your information. We do not sell your information.

Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if we need to do so to protect the Service or other users. If we discontinue the Service, we will give reasonable notice where possible.

Disclaimers

The Service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or that puzzles will be available on any particular schedule.

Limitation of Liability

To the fullest extent permitted by law, Grailbox, LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim or US $10.

Nothing in these Terms limits liability that cannot be limited by law, such as liability for death or personal injury caused by negligence, or for fraud.

Governing Law and Disputes

These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict of law rules. Any dispute arising from these Terms or the Service will be resolved exclusively in the state or federal courts located in Florida, and you consent to the jurisdiction of those courts.

If you are a consumer in the European Economic Area, the United Kingdom, or another country whose laws give you the right to bring claims in your home courts or under your local consumer protection laws, nothing in these Terms takes away those rights.

Apple App Store Users

If you downloaded the app from the Apple App Store:

• These Terms are between you and Grailbox, LLC only, not Apple. Grailbox, LLC, not Apple, is solely responsible for the app and its content.
• Apple has no obligation to provide maintenance or support for the app.
• If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
• Apple is not responsible for addressing any claims by you or any third party relating to the app, including product liability claims, claims that the app fails to conform to legal or regulatory requirements, and consumer protection claims.
• If a third party claims the app infringes their intellectual property rights, Grailbox, LLC, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of that claim.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you in the app or on this page and update the “Last updated” date above. Continuing to use the Service after changes take effect means you accept the updated Terms.

General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce any provision is not a waiver. These Terms, together with our Privacy Policy, are the entire agreement between you and us about the Service.
